TERMS OF USE
Texas Data Center Academy LLC
Effective Date: September 15, 2026
Welcome to Texas Data Center Academy. These Terms of Use govern enrollment in and use of training programs, courses, websites, learning platforms, educational materials, and related services provided by Texas Data Center Academy LLC (“Texas Data Center Academy,” “TDCA,” “we,” “us,” or “our”).
By creating an account, enrolling in a program, purchasing a course, or accessing our training materials, you acknowledge that you have read and agree to these Terms of Use.
1. Training Programs
Texas Data Center Academy provides technical education and professional training in areas including data center operations, IT infrastructure, networking, Linux, critical environments, data center logistics, cloud infrastructure, and related technologies.
Programs may include:
- Online video lessons and instructional materials
- Practical exercises, labs, and assignments
- Quizzes and assessments
- Downloadable educational resources
- Live or one-on-one instructor support
- Technical mentoring
- Resume and interview preparation
- Career-readiness support
- Capstone projects and final evaluations
Program content, lesson organization, training materials, and instructional methods may be updated periodically to maintain the relevance and quality of the training.
2. Program Duration and Course Access
Unless otherwise stated on the applicable program enrollment page, Texas Data Center Academy programs are structured as 8-week training programs.
Course materials may be released progressively according to the program schedule.
Students are responsible for maintaining the internet connection, computer equipment, software, and other resources necessary to participate in online training.
Access to training materials is provided only to the enrolled student and may not be transferred to another person.
3. Tuition and Payment
The applicable tuition and available payment options are displayed before enrollment.
Students may be offered the option to pay tuition in full or through an installment payment plan.
By selecting an installment plan, the student authorizes the applicable payment processor to process the scheduled payments according to the payment plan presented at checkout.
A payment plan represents payment of the total tuition in installments and is not a month-to-month subscription unless expressly stated otherwise.
If a scheduled payment cannot be successfully processed, Texas Data Center Academy may temporarily suspend course access while the payment issue is being resolved. Students experiencing billing problems are encouraged to contact us promptly.
4. Refund and Cancellation Policy
Students may request cancellation and a refund within 7 calendar days of their initial enrollment and first payment.
Refund requests must be submitted in writing to Texas Data Center Academy within this period.
After the 7-day refund period, tuition and payments are generally non-refundable because students have been provided access to proprietary educational content, training materials, instructional resources, and instructor support.
If a student enrolled using an installment payment plan, cancellation after the applicable refund period does not automatically eliminate payment obligations already agreed to at enrollment.
Texas Data Center Academy may consider documented exceptional circumstances individually and may approve a full or partial refund at its discretion where appropriate.
If Texas Data Center Academy cancels a training program and cannot provide a reasonable alternative or complete the training purchased by the student, TDCA will provide an appropriate refund for the portion of the training that was not delivered.
Nothing in this policy limits any refund, cancellation, withdrawal, or other consumer rights that cannot legally be waived under applicable law.
5. Student Responsibilities
Students agree to:
- Provide accurate enrollment and account information.
- Maintain the confidentiality of their login credentials.
- Use course materials solely for their personal educational purposes.
- Complete assignments and assessments honestly.
- Follow reasonable instructor and platform requirements.
- Conduct themselves professionally during live sessions and communications.
- Refrain from interfering with the learning experience of other students.
Texas Data Center Academy reserves the right to restrict or terminate access for serious misuse of the platform, fraud, harassment, unauthorized distribution of course materials, or other material violations of these Terms.
6. Educational and Career Disclaimer
Texas Data Center Academy provides education, technical training, professional development, and career-preparation services.
Enrollment or completion of a TDCA program does not guarantee employment, a job offer, promotion, salary level, professional certification, or employment with any particular company.
Employment outcomes depend on numerous factors outside TDCA's control, including a student's qualifications, experience, performance, location, interview performance, employer requirements, background requirements, and labor-market conditions.
References to technologies, industry practices, or companies are provided for educational and career-awareness purposes and do not constitute a guarantee of employment.
Unless expressly stated otherwise, Texas Data Center Academy is an independent training organization and is not affiliated with, endorsed by, sponsored by, or acting on behalf of employers or technology companies referenced in its educational materials.
7. Certificates of Completion
Students who satisfy applicable program requirements may receive a Texas Data Center Academy Certificate of Completion.
A TDCA Certificate of Completion recognizes completion of the applicable training program. It is not a government license, professional license, academic degree, or third-party industry certification unless expressly stated otherwise.
8. Intellectual Property
Course videos, presentations, field guides, documents, diagrams, assignments, quizzes, training materials, graphics, and other TDCA educational content are owned by or licensed to Texas Data Center Academy and are protected by applicable intellectual-property laws.
Enrollment provides the student with a limited, personal, non-exclusive, non-transferable right to use the materials for their own education.
Without prior written authorization from Texas Data Center Academy, students may not reproduce, sell, redistribute, publish, upload, share, record, copy, or commercially exploit TDCA training materials.
9. Third-Party Platforms and Services
Texas Data Center Academy may use third-party services for learning management, payment processing, communications, video delivery, virtual meetings, and other operational purposes.
These services may include providers such as Thinkific and Stripe.
Temporary interruptions or technical issues involving third-party services may occasionally occur. Texas Data Center Academy will make reasonable efforts to address disruptions affecting the delivery of its training services.
10. Technical Training and Safety
TDCA training is provided for educational purposes.
Students must not perform work on energized electrical systems, production data center equipment, critical infrastructure, or other potentially hazardous equipment unless they are appropriately trained, authorized, and following the applicable employer, facility, manufacturer, and safety procedures.
TDCA training does not replace site-specific authorization, safety training, employer procedures, or manufacturer instructions.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Texas Data Center Academy LLC will not be liable for indirect, incidental, special, or consequential damages arising from the use of its training programs or educational materials.
Nothing in these Terms excludes or limits liability or consumer rights that cannot legally be excluded or limited.
12. Changes to These Terms
Texas Data Center Academy may update these Terms of Use when necessary to reflect changes to its programs, services, technology, or legal requirements.
The current version will be published with an updated effective date. Material changes will apply prospectively where required by applicable law and will not be used to retroactively alter payment or refund rights already agreed to by students where prohibited.
13. Governing Law and International Students
These Terms of Use are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law principles.
Texas Data Center Academy provides online training services to students in the United States and internationally. Nothing in these Terms is intended to exclude, restrict, or waive any mandatory consumer rights or protections that apply to a student under the laws of their country, state, province, or other jurisdiction and that cannot legally be waived by agreement.
